In brief

On 1 April 2021, Decree-Law No. 4/20201 has been published in the Italian Official Gazette whose Section 4 introduces the compulsory vaccination against COVID-19 for healthcare professionals and operators and provides a detailed procedure for its operation and sanctions in case of non-compliance.

In particular, the Decree-Law establishes that healthcare professionals and operators carrying out their activities in public or private healthcare structures, pharmacies, para-pharmacies and doctor offices must undergo a free vaccination for the prevention of the infection by SARS-CoV-2.

In this respect, the Decree-Law clarifies that the fulfilment of the vaccination obligation is an essential requirement for the exercise of the medical profession and the performance of work activities by those obliged. In fact, except where there is a proven health danger related to specific documented clinical conditions, the failure to perform the vaccine is sanctioned with the assignment to different tasks or with the suspension of wage.
