Germany: Federal Ministry of Justice Publishes Draft for Corporate Liability Law

Nicolai Behr is a compliance and dispute resolution attorney in Baker & McKenzie’s Munich office. He is a member of the steering committee of GlobalComplianceNews, a compliance news website with global reach moderated by Baker & McKenzie. Dr. Andreas Lohner is a compliance and corporate partner in the Firm’s Munich office. He is a seasoned lawyer with 20 years of experience advising on various areas of law such as corporate law, corporate compliance issues and internal investigations. Andreas is co-head of the German Compliance Group and serves as chair of the European Compliance Steering Committee.

Dr. Anika Schürmann is a counsel in Baker McKenzie’s Düsseldorf office. She joined the Firm in 2013, and advises in antitrust and competition law, as well as in white collar crime and compliance investigations. She is admitted to the Dusseldorf bar and is a member of the German Association of Antitrust Lawyers as well as the Criminal Law Section of the German Bar Association. Prior to joining Baker McKenzie, Mrs. Schürmann was a member of Freshfields Bruckhaus Deringer’s antitrust team (2007-2011), and practiced in a Düsseldorf law firm that specializes in white collar crime law (2012-2013).

Stephan Spehl is a dispute resolution partner in Baker & McKenzie's Munich office. For more than 25 years Stephan has been representing numerous clients in complex commercial disputes before state courts, and in ad hoc or institutional arbitration proceedings. He was party-appointed arbitrator in various ad-hoc proceedings. He also focuses his practice on compliance and internal investigations. He is the co-editor of the book "Coporate Internal Investigations", an overview of 13 jurisdictions.

Johannes Weichbrodt is a senior associate in Baker & McKenzie´s Dusseldorf office. He advises on all aspects of European and German antitrust and competition law. Before joining the firm in 2015, Dr. Weichbrodt was with the antitrust practice at Freshfields Bruckhaus Deringer for over five years, ultimately as principal associate. In 2014, he was seconded to ThyssenKrupp AG where he worked in the compliance department. He is admitted to the Dusseldorf Bar and is a member of the German Association of Antitrust Lawyers.

Dr. Robin Haas is a senior associate in Baker McKenzie’s Munich office. He is a member of the Compliance and Investigation Group and one of the innovation ambassadors at the Munich office. Robin joined the Firm in 2015 after studying law in Mannheim (Dr. jur.), Swansea (University of Wales, Erasmus) and New York (Columbia University, LLM). He has previously worked in our offices in Frankfurt and Zurich.

Dr. Björn Bastian Boerger is an associate in Baker McKenzie’s Munich office and a member of the Corporate Practice Group. Prior to joining the Firm, he spent his legal clerkship in the jurisdiction of the Higher Regional Court of Karlsruhe. During this period, he clerked at another international law firm in Berlin and Washington, DC, focusing on internal investigations and white collar crime. Björn also served as a research assistant at the University of Freiburg, where he authored a number of publications on white collar crime as well as liability of management in a comparative law context.
