Resolution No. 98/2024

By means of Resolution 98/2024 (“Resolution“), the Secretariat of Industry and Commerce regulates the procedure through which companies and individuals avail themselves of the leniency benefit provided by the Antitrust Law No. 27,442 (“Antitrust Law“).


In depth

The Resolution, which follows international guidelines and practices, is an important step to providing the National Antitrust Commission (CNDC) with the necessary tools to fight against cartels. This is because the Resolution creates a Leniency Unit within the CNDC with the purpose of preserving the confidentiality of the information that adherents to this regime provide to the CNDC, thus encouraging potential filings before the CNDC.

The Resolution will be in force until the creation of the National Competition Authority provided for by the Antitrust Law. Once the Authority is created, it will have to issue a new procedural regulation in accordance with its structure and operation.
