On 16 February 2023, Argentina signed the Second Additional Protocol to the Convention on Cybercrime, known as the Budapest Convention, becoming its 35th signatory state. The Second Protocol responds to the challenge of obtaining electronic evidence that may be stored in foreign jurisdictions when carrying out criminal investigations. It also aims to provide tools to enhance cooperation and disclosure of electronic evidence.
11 March 2023 will mark the entry into force of Mexican Official Standard NOM-001-SEMARNAT-2021, that establishes maximum allowable limits for pollutants in wastewater discharges into national receptive bodies. This standard, substitutes NOM-001-SEMARNAT-1996.
Two new regulations were published on 13 February 2023. The regulations, which directly impact the business sector, are the following: (i) Federal Decree No. 11,413/2023, which established three new reverse logistics credit certificates at the federal level: the Reverse Logistics Recycling Credit Certificate, the Certificate of Structuring and Recycling of Packaging in General and the Future Mass Credit Certificate; and (ii) Federal Decree No. 11,414/2023, which reinstituted and reformulated the pro-scavengers program, subject of former Federal Decree No. 7,405/2010, revoked in 2020.
By Decree No. 57/2023 issued on 3 February 2023, the National Executive Power cancelled the 5% export refund on exports of lithium, lithium oxide and hydroxide, lithium chloride and lithium carbonate produced in the provinces of Catamarca, Jujuy and Salta.
On 1 February 2023, State Decree No. 112/20231 was published, establishing the take-back requirements system for packaging in the state of Mato Grosso. The decree is the first specific regulation on the subject in MT, regulating the state policy for solid waste (Law No. 7,862/2002) in this regard.
On 30 November 2022, Legislative Decree Number 111 was published in the Official Gazette of the Government of the State of Guanajuato.
The Decree, which came into effect 1 January 2023, added “Ecological Taxes for Environmental Remediation,” to the Finance Law for the State of Guanajuato under Chapter Eight, Title Two and established three ecological taxes
On 12 January 2023, Provisional Measures, Decrees and Ordinances were published with the purpose of reducing the Federal Government’s budget deficit.
On 29 December 2022, the National Executive issued Decree No. 4,758, which adopts the legal regime of goods and the Common Customs Tariff Schedule of the States Parties of MERCOSUR (NCM). The Decree entered into force on 3 January 2023, five days after its publication on 29 December 2022.
The Brazilian Federal Revenue Service’s Normative Instruction No. 2119, published on 6 December 2022, amended the provisions on the requirements to the General Taxpayer’s Registry under the Brazilian Federal Revenue Service, as well as the provisions related to the Disclosure of Ultimate Beneficial Owner with the Federal Revenue Service.
The National Executive issued the Decree No. 4,766 on 9 January 2023, which extends the waivers of Legal Regimes for export until 9 June 2023. Said waivers were established on 9 June 2021 by the Decree No. 4,5252 regarding Optimization of Export Processes, which was extended until June 2022. The Decree established its validity as of 9 December 2022, having a retroactive effect.
