Salary increase 2022-2023

In brief

On Tuesday 3 May 2022, the Ministry of Labor, Employment and Social Security, through Resolution 826/2022, approved the collective agreement (“Agreement“) signed between the Argentine Federation of Commerce and Services Employees, the Argentine Chamber of Commerce and Services, the Argentine Confederation of Medium Enterprises and the Argentine Union of Commercial Entities.

The Agreement establishes new salary conditions applicable to employees covered by the Collective Bargain Agreement 130/75 (“CBA 130/75“) effective from 1 April 2022 to 31 March 2023.
 


In depth

The Agreement establishes the following conditions:

  1. A non-remunerative salary increase of 59.5% is to be applied in seven installments, applicable over the salary scales for April 2022, according to the following schedule:+
    • 6% as of April 2022
    • 6% as of May 2022
    • 6% as of June 2022
    • 10% as of August 2022
    • 10% as of September 2022
    • 11% as of November 2022
    • 10.5% as of April 2022

The salary increase must be paid under the item “non-remuneration increase — Agreement 2022,” in a full or abbreviated manner. For part-time employees, it will be paid proportionally. 

  1. The salary increase will be paid on a non-remunerated basis until April 2023, after which it will be included in the basic salary. Therefore, as long as it maintains a non-remunerative nature, it will not be considered for the payment of withholdings and contributions to the social security subsystems, except for: (a) contributions to medical coverage (OSECAC); (b) union contributions (Sections 100 and 101 of the CBA 130/75); and (c) contributions to the Argentine Institute of Professional and Technological Training for Commerce (INACAP).
  2. The agreed salary increase, as long as it maintains its non-remunerative nature (until April 2023), will not apply additional payments of the CBA 130/75 (seniority payment, attendance bonus, etc.); nor will it be considered when calculating the payment of the thirteenth salary.
  3. Increases unilaterally granted by employers cannot be subsumed or offset, except for those granted after 1 January 2022 and paid as an advance of future increases. 
  4. For the period April 2022 to March 2023, the contribution of ARS 100 that employees must make every month to OSECAC will remain in force, and the solidarity contribution of ARS 600 for each worker is to be paid by their employers.
