ASIC has released a new immunity policy setting out the process and conditions for whistleblowers to obtain immunity from certain civil penalty or criminal proceedings (Immunity Policy). The Immunity Policy extends the types of protection available to a whistleblower beyond those which became available under the Treasury Laws Amendment (Enhancing Whistleblower Protections) Act 2019 (Cth) (Whistleblowing Legislation) which came into force in 2019. As a result there is an increased risk that employees may elect to go direct to ASIC rather than raising an issue internally.

The COVID-19 pandemic has accelerated (and for some, cemented) the work from home trend. As a result, many employers are increasingly turning to employee monitoring technology to replace the physical employee oversight once enjoyed in the office. While employers have many legitimate reasons for monitoring employee activity, the decision to monitor employees is not without its legal and ethical complexities.
The government has announced that due to the continuing impact of the pandemic, the gender pay gap reporting deadline for the 2020/21 reporting period will be extended by six months to 5 October 2021 for qualifying employers in the private sector. Employers are, however, encouraged to report their figures before the deadline.
On 2 February, the Indonesian government enacted a number of implementing regulations of Law No. 11 of 2020 on Job Creation (“Omnibus Law”), though many were only made available to the public on 21 February.
